Terms and Conditions

You may cancel this contract from the day you enter into the contract until 3 days after you receive a copy of the contract. You do not need a reason to cancel.

Any rendering shown is to give a general idea of color and style, and not be construed as what the final product will look exactly like. Small details, size, trim sizes, and where lap and trim go will not be base don the rendering but your actual home.

If you cancel this contract, the seller has 15 days to refund your money. You must then return the goods. To cancel, you must give notice of cancellation at the address in this contract. You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax, or by personal delivery.

Fairway Exteriors LLC orders extra materials to ensure that we have what we need and in a timely manner. This product is the property of Fairway Exteriors LLC at the end of your project.

I understand that I must remove items from the interior walls of my home that may be damaged or fall due to vibrations from the installation of siding. Fairway Exteriors LLC is not liable for such damages. Drywall cracking and nail popping from vibrations are a natural occurrence. Fairway Exteriors LLC cannot be held liable for said instances.

Fairway Exteriors is not responsible or liable for any pre-existing construction defects. This includes, but is not limited to, framing or structural deficiencies, damaged roofs/flashing details, cracks in walls, foundation, or brick that are already deteriorating.

Fairway Exteriors shall not be liable for failure of performance under this contract due to weather, labor controversies, fires, inability to obtain materials from usual sources, or any other circumstances beyond Fairway Exteriors control.

PURCHASER/Homeowner is responsible for compliance with any homeowner’s association, city, county, subdivision, or municipal requirements or restrictions that may regulate or affect the work to be performed under this contract. This includes specific restrictions on material or color selections.

All claims and disputes arising or related to the project, the work, or this proposal shall be settled by arbitration in accordance with the Construction Industry Arbitration Rules of America Arbitration Association currently in effect.

Notice of demand for arbitration shall be filed in writing with the other party and the American Arbitration Association. All demands shall be made within a reasonable time after the claim or dispute has arisen.
I understand that this is an active job site and that I need to wear proper footwear and attire when walking around the job site. I also understand that I am solely responsible for my pets/animals and their well-being when they are on the job site. Fairway Exteriors cannot be held liable for my pets/animals.

PURCHASER/Homeowner will not walk under or near the work area during the tear-off/demo of the siding. Fairway Exteriors shall not be liable for any injuries to persons or pets. PURCHASER/Homeowner agrees to indemnify and hold harmless Fairway Exteriors for any and all claims made against Fairway Exteriors arising from Fairway Exteriors performance of this Agreement.

I understand that any warranty for material used during the project is provided by the material manufacturer. Unless agreed upon otherwise, Fairway Exteriors LLC provides a Limited Lifetime Workmanship Warranty on portions of the project in which Fairway Exteriors LLC fully replaced any existing products.

Driveway damage could occur from the dumpster, but all issues and damages are between the homeowner and the dumpster company. Fairway Exteriors LLC cannot be held liable.

If any unforeseen electrical issues arise homeowner will contract with a licensed electrician and will be solely responsible for all costs associated. Including if our nail hits a wire inside the wall.

I understand that payment in full is due upon completion of work as stated in the contract. All invoices not paid in full after 15 days will be subject to a 2% per month interest charge.
